In accordance with Costa Rica's Law No. 8968 on the Protection of Individuals Regarding the Processing of Their Personal Data, and Decree 40703-MEIC on consumer protection in electronic commerce, we provide the following information about our data processing practices.

2. Data We Collect

Information you provide voluntarily: When you use our contact form, book a retreat, schedule a Healing Studio session, take our Enneagram test, or subscribe to our newsletter, we may collect: your name, email address, phone number, subject of inquiry, and message content.

Retreat and program bookings: For retreat reservations and programs such as 9Seeds™, we may additionally collect: full legal name, passport or ID number, date of birth, emergency contact information, and payment details.

Sensitive health data (Art. 3, Law 8968): For our Healing Studio integrative psychology sessions, 9Seeds™ addiction treatment program, and retreat participation, we may collect health-related information including: mental and physical health history, current medications, substance use history, psychological assessments, and Enneagram results used in therapeutic context. This data is classified as sensitive under Costa Rican law and is processed only with your explicit, informed consent.

Automatically collected data: When you visit our website, we may automatically collect: IP address, browser type and device information, pages visited and time spent on the site, and referral source. This data is collected through cookies and similar technologies (see Section 7).

3. Purpose of Data Processing

We process your personal data for the following purposes: (a) to manage retreat reservations and communicate about contracted services; (b) to provide integrative psychology, homeopathy, and complementary therapeutic services through the Healing Studio; (c) to administer the 9Seeds™ program and ensure appropriate follow-up; (d) to process Enneagram test results and provide personalized insights; (e) to send marketing communications about our services, events, and programs — only with your prior consent; (f) to improve our website, services, and user experience; and (g) to comply with legal and regulatory obligations.

We will not process your data for purposes other than those stated above. If we wish to use your data for a new purpose, we will contact you to request permission.

5. Your Rights (ARCO Rights)

Under Article 7 of Law 8968, you have the right to: Access — know what personal data we hold about you; Rectification — correct inaccurate or incomplete data; Cancellation — request the deletion of your data; and Opposition — object to the processing of your data for specific purposes.

To exercise any of these rights, send an email to info@dynamiscr.com with the subject line "Data Rights Request" and include your full name and identification. We will respond within 10 business days as required by law.

If you believe your data protection rights have been violated, you may file a complaint with the Agencia de Protección de Datos de los Habitantes (PRODHAB) — the regulatory authority in Costa Rica.

6. Data Sharing and Third Parties

We do not sell, trade, or rent your personal data to third parties. We may share data with trusted service providers who assist us in operating our website and business, including: Vercel (website hosting), payment processors for retreat bookings, Google Analytics (anonymized website usage data), and email service providers for newsletter delivery.

These providers are contractually bound to maintain the confidentiality of your data and use it only for the purposes specified. We may also disclose data when required by law or to protect our rights, property, or safety.

7. Cookies and Tracking Technologies

Essential cookies: Required for the website to function properly, including language preference (EN/ES) and session management. These cannot be disabled.

Analytics cookies: We use Google Analytics to understand how visitors interact with our website. This data is anonymized and aggregated. You may opt out of these cookies.

Marketing cookies: If enabled, these allow us to measure the effectiveness of our advertising campaigns. These are only activated with your explicit consent.

When you first visit our website, you will be presented with a cookie consent banner where you can accept or reject non-essential cookies. You can manage your preferences at any time through the cookie settings accessible on every page.

8. Data Retention

We retain your personal data only for as long as necessary to fulfill the purposes for which it was collected: reservation and payment data is retained for 5 years for accounting and legal compliance; clinical and therapeutic data is retained according to regulations of the Colegio de Psicólogos de Costa Rica; marketing data (newsletter) is retained until you withdraw your consent; website analytics data is anonymized and retained for 26 months.

In no case will personal data that may affect its holder be retained for more than 10 years from the occurrence of the recorded events, in accordance with Article 6 of Law 8968.

9. Data Security

We implement appropriate technical and organizational security measures to protect your personal data, including: HTTPS/SSL encryption for all data in transit; restricted access to personal data on a need-to-know basis; secure hosting infrastructure; and enhanced protocols for sensitive clinical data.

In the event of a data breach that affects your personal data, we will notify you and the relevant authorities as required by law.

10. Children's Privacy

Our services are not directed to individuals under 18 years of age. We do not knowingly collect personal data from minors. If you believe we have inadvertently collected data from a minor, please contact us immediately at info@dynamiscr.com.

11. Changes to This Policy

We may update this Privacy Policy from time to time. Any changes will be posted on this page with an updated "Last updated" date. We encourage you to review this policy periodically.

For material changes that affect how we process sensitive data, we will notify you directly via email or a prominent notice on our website.

12. Governing Law

This Privacy Policy is governed by the laws of the Republic of Costa Rica, particularly Law No. 8968 on the Protection of Individuals Regarding the Processing of Their Personal Data, and its implementing regulations. Any dispute shall be resolved in the courts of Guanacaste, Costa Rica.
